United States Residence by Investment

The United States offers a well-known EB-5 Immigrant Investor Program, which allows investors and their families to obtain a U.S. Green Card (permanent residency) by making qualifying investments in the U.S. economy. This program provides a direct pathway to U.S. citizenship after a period of residency.

Key Requirements
  • Investment Commitment:
The investor must demonstrate that the investment capital is lawfully obtained and remains at risk throughout the process.
  • Job Creation Requirement:
The investment must result in the creation of at least 10 full-time jobs for U.S. workers within two years.
  • Business Documentation (for Direct Investment):
If choosing direct investment, a detailed business plan showing how the jobs will be created and sustained must be provided.
  • Clean Criminal Record:
A clean criminal record is required for all family members over 16 years of age.
  • Age Requirement:
The applicant's spouse and unmarried children under 21 can apply for green card without any further financial contributions.
Application Process
  • Select Investment and File I-526 Petition

The first step is selecting a qualified investment (either direct or through a Regional Center) and filing the I-526 Immigrant Petition by Alien Investor with U.S. Citizenship and Immigration Services (USCIS). The petition includes proof of investment, business plan, and evidence of job creation potential.

  • USCIS Review and Approval

USCIS reviews the petition to ensure all eligibility criteria are met, including lawful investment, job creation, and the business plan. Upon approval, the investor receives a conditional Green Card, valid for two years.

  • Conditional Green Card

The investor and their family are granted conditional permanent residency in the U.S. Once they arrive in the U.S., they can live, work, and study without restrictions.

  • I-829 Petition and Permanent Green Card

After two years of conditional residency, the investor must file an I-829 Petition to remove the conditions. This petition must demonstrate that the investment remained active and that the required jobs were created. Upon approval, the conditions are removed, and the investor and family members receive a permanent Green Card.

  • Pathway to Citizenship

After five years of permanent residency (including the two years of conditional residency), the investor and their family may apply for U.S. citizenship, provided they meet residency and other naturalization requirements.
